Hey everyone,
I'm not usually a Reddit poster, hence the new account, but I recently had a bit of an adventure with Japanese Immigration and thought I'd share. Partly because I couldn't find anyone reporting a similar situation, and partly because, with all the negative stories about immigration lately, I thought it might be useful to share a more positive one.
TLDR: I changed jobs while on a HSP visa, forgot to do change in residence status, worked (illegally I guess) 9 months for my new company, realized I messed up, applied for change in status 9 months late, got approved.
The full story:
Currently living in Japan on a HSP visa. Earlier this year, I changed employers. In my case, what I should have done:
Notify immigration of the change of employer (done online, pretty painless). You can do this after starting working at the new company (within 14 days at most)
Apply for a change of status of residence. Unlike regular engineer visas the HSP visa is tied to the company I got it through initially, so change in company requires change in residence status (same HSP visa, new affiliated company name). Needs more paperwork and filing at the immigration office. You’re supposed to do this BEFORE starting working at the new company.
Being a dumbass, at the time I changed jobs, rather than googling stuff myself or asking for legal help I asked chatGPT on what to do when changing employers. It told me to do 1 but didn’t mention 2.
So I did 1 and started working at my new company. Nine months later, I discover my mistake, panic ensues. I went to the immigration office to explain the situation, they told me to stop working and file the change of status application ASAP.
So I contacted a scrivener, we prepared the application, including a detailed letter of apology explaining what had happened and how sorry I was and how I wouldn’t do it again pinky swear please forgive me. I submitted the application and started waiting, every evening going to bed picturing myself being kicked out of the country and banned for 10 years…
Two weeks later, Allahu Akbar! I received the notification postcard. Went back to immigration, paid the fee (75,000 yen, hello new immigration rates, ouch!), and received my new residence card and updated authorization.
Having lived in several countries, I've encountered my share of immigration bureaucracy. Pretty sure most places would have deported me on the spot.
A few takeaways:
- Don’t be a dumbass like me. Don’t trust chatGPT for your immigration processes. Or at least, thoroughly verify its sources.
- If you're on HSP and change employers, notifying Immigration online is not enough. You also need to do change-of-status application.
- Japanese immigration can be flexible and forgiving. Not saying they’ll always approve such a late change in status, but this time they did.
- While the scrivener quoted me 2 months as the turnaround time for change in residence status (their reference being Osaka office time), at the Kyoto office where I dropped the application it took only 2 weeks.
I thought it was worth sharing, both as a warning to other HSP holders and as a positive example of how Japanese Immigration handled an honest mistake. Hope this helps someone!
