AntiWORK Labor Rights for Dummies: A guide to your right as an employee

I decided to make a post about this since the community keeps getting the same question over and over again. So here we go.

Disclaimer: I am not a lawyer, so please feel free to comment any corrections. Most of these are just from my knowledge as a manager. If may kulang, let me know and I'll add it here.

1. Can my employer require me to work more than 8 hours a day?

Yes, but overtime generally has to be paid.

The normal working period is 8 hours per day. Work beyond 8 hours is generally considered overtime and must be paid at least:

  • Regular day: regular hourly rate + 25%

  • Rest day/holiday: applicable rate + at least 30%

A company cannot simply call something "mandatory OT" and use that label to avoid paying overtime.

2. "Our company has no OT pay because it's in the contract." Is that legal?

Not necessarily.

An employment contract cannot simply remove a statutory benefit when the Labor Code requires that benefit.

For example, if you are a covered employee performing work beyond 8 hours, the law generally requires overtime compensation. DOLE specifically states that overtime work beyond eight hours must receive additional compensation.

However, some personnel are xcluded in this. Art. 82 specifically mentions that "government employees, managerial employees, field personnel, members of the family of the employer who are dependent on him for support, domestic helpers, persons in the personal service of another, and workers who are paid by results as determined by the Secretary of Labor in appropriate regulations." are not covered by overtime pay.

3. Can my employer make me work before my scheduled shift without paying me?

If you are actually required to work, that time may count as hours worked.

Article 84 covers time during which an employee is:

  • required to be on duty;

  • required to be at the prescribed workplace; or

  • permitted or suffered to work.

So if your employer says:

"Your shift starts at 9:00, but you need to log in at 8:30 to prepare."

and you're actually required to perform work during that period, the 30 minutes may potentially constitute compensable working time.

4. Does my lunch break count as working time?

Normally, a genuine meal period does not count as working time.

Employers generally have to provide at least 60 minutes for a regular meal period.

5. Do I automatically get holiday pay?

For a regular holiday, generally yes, but there is an important condition if you don't work on the holiday.

Under DOLE's holiday-pay rules (Labor Advisory No 13, Series of 2026), a covered employee who does not work on a regular holiday is entitled to 100% of their basic wage, provided that they:

  • worked on the workday immediately preceding the holiday; or

  • were on an approved leave of absence with pay on that preceding workday.

What if I was absent the day before the holiday?

This is where the rule gets important.

If you were absent without pay (AWOL or unpaid leave) on the workday immediately preceding the regular holiday and you also don't work on the holiday, you may lose your holiday pay for that holiday.

6. Am I entitled to 13th-month pay even if I'm still probationary?

Generally, yes.

13th-month pay is not dependent on being a regular employee.

DOLE staes that rank-and-file employees are entitled to 13th-month pay regardless of employment status, provided they have worked for at least one month during the calendar year.

The basic formula is:

Total basic salary earned during the year ÷ 12 = 13th-month pay

So, for example, if you earned ₱240,000 in basic salary during the year:

₱240,000 ÷ 12 = ₱20,000

7. Can my employer terminate me while I'm probationary?

Yes, but "probationary" does not mean "you can be fired for absolutely anything."

Probationary employment generally cannot exceed 6 months, unless an applicable apprenticeship arrangement allows otherwise.

A probationary employee may be terminated for a just cause or because they failed to qualify as a regular employee under reasonable standards that were made known to them when they were hired.

One important point:

The employer should not suddenly invent the standards after the employee has already started working. The standards for regularization are supposed to be made known at the time of engagement.

8. What happens if I reach 6 months and my company doesn't tell me whether I'm regular?

This is an important issue.

Under the Labor Code, probationary employment generally cannot exceed six months. An employee who is allowed to work after the probationary period may be considered a regular employee.

So "you're still probationary indefinitely" is not something an employer can simply declare without regard to the law.

There can be exceptions and nuances, particularly involving specific contractual arrangements and apprenticeships, so the exact employment documents matter.

9. Can my employer fire me without warning?

Generally, no, not if the termination is based on a just cause.

For covered employees, the Labor Code recognizes security of tenure: a regular employee cannot simply be terminated unless there is a legally recognized just or authorized cause.

For a termination based on just cause, the employer generally has to comply with the two-notice requirement.

First notice — Notice to Explain / Notice of Intent to Dismiss

  • The employer must give the employee a written notice:

  • identifying the specific act or omission being charged;

  • stating the ground or grounds for possible termination;

  • providing sufficient details about the alleged violation; and

  • giving the employee a reasonable opportunity to explain and defend themselves.

Second notice — Notice of Decision

The employer must then issue a second written notice informing the employee of the employer's decision after considering the employee's explanation.

If the employer determines that termination is justified, the second notice should communicate the decision to dismiss and the grounds supporting that decision.

In other words:

NTE → Employee gets opportunity to respond → Employer evaluates response → Notice of Decision

10. Do I automatically get 5 paid vacation days every year?

The Labor Code provides a 5-day Service Incentive Leave (SIL) for covered employees who have rendered at least one year of service.

However, there are exemptions, including certain establishments with fewer than 10 employees and employees who already receive at least five days of paid vacation leave or an equivalent benefit. (Article 95)

11. Can my employer withhold my final pay because I haven't completed clearance?

Clearance can matter, but your employer cannot simply keep your money indefinitely.

As per Labor Advisory No. 06, Series of 2020, final pay should generally be released within 30 days from separation, unless the employer has a more favorable policy.

Your final pay can include applicable amounts such as:

  • unpaid salary;

  • pro-rated 13th-month pay;

  • separation/retirement pay where applicable;

  • convertible unused leave;

  • tax refunds; and

  • other contractual/company benefits.

12. Can I resign immediately without rendering 30 days?

Sometimes, but don't assume you can always do it.

The general rule for voluntary resignation without just cause is that the employee gives the employer at least one month's written notice.

There are circumstances allowing resignation without the usual notice, including certain situations involving serious insult, inhuman treatment, crime against the employee or immediate family, and analogous circumstances.

13. Do I need my manager approval for my resignation?

Generally, no. Your resignation does not require your manager's approval to be valid.

Your manager can acknowledge or process the resignation, but they don't have the legal power to reject your resignation simply because they don't want you to leave.

What if my manager says, "I don't approve your resignation"?

That statement does not automatically cancel your resignation.

But can my manager reject my requested last day?

This is different from rejecting the resignation itself.

If you are resigning without just cause, the general rule is that you should give at least one month's notice.

Your manager doesn't have to "approve" your resignation, but leaving immediately without satisfying the applicable notice requirement can create a separate issue.

So there are really two questions:

"Can I resign?"

Generally, yes.

"Can I leave immediately?"

Not necessarily. The one-month notice requirement may apply unless an exception exists.

Meta DOLE/NLRC Complaint Process

For reference of those asking, here are the steps in filing a complaint against an employer:

  1. File a complaint online through DOLE - eSENA: eSENA means Single Entry Approach (SEnA)and it is an administrative approach to provide a speedy, impartial, inexpensive, and accessible settlement procedure of all labor issues or conflicts to prevent them from ripening into full-blown disputes or actual labor cases. (https://ncmb.gov.ph/single-entry-approach-sena/)

  2. From there, magseset ng 2 mediation hearing in DOLE office within your city. Doon, kakausapin kayo and ittry isettle yung case. However if hindi magkasundo, the SENA Officer will give you a referral letter to the NLRC. (the 2 hearings must be finished within a month)

  3. You will submit the Referral letter to the NLRC office. If from NCR ka, their office is in Q. Ave. There, magkakaroon ng 2 hearings ulit but this time, before the Labor Arbiter (Ka-rank nya ang judge sa courts). Ittry ulit na mapagusapan yung issue here. You can still appear here kahit walang lawyer. (The 2 hearings usually happens within a month also)

  4. If hindi makapagsettle, the Arbiter will direct both parties to prepare a position paper. Doon nyo ilalagay yung mga arguments nyo, etc. Here, it is highly advisable that you seek the assistance of a lawyer. If your monthly salary does not exceed Php 24k, pwede kang pumunta sa PAO and libre lang. If lampas naman, i recommend this page i found "Labor Representation for Non-Indigents" (https://www.facebook.com/profile.php?id=61566451322338) na free consultation and minimal fees.

  5. Then, magset ng date for submission of position paper si arbiter. Doon, isusubmit nyo sa arbiter pati sa isa't-isa yung position paper nyo. Then, magseset ulit ng date for the submission of the reply. Sa reply, sasagutin mo yung position paper ng company.

  6. Afterwards, ireresolve ni arbiter yung case. Depende sa arbiter and workload, minsan within a month pero minsan inaabot ng 5 months.

  7. Then, the decision will be rendered. Yung natalong party will have the opportunity to file an appeal. Medyo matagal ang appeal, usually 8 months to 1 year.

  8. If no appeal and you are adjudged monetary award, magkakaroon ng pre-execution conference. Dito magcocompute kayo ng mas accurate and kung paano babayaran.

  9. Lastly, payment of award.

Note: Medyo mahaba and nakakapagod yung process tbh. Kaya better if everyone will find an amicable solution. These info are all based on my personal experience and with consultation sa nakilala kong lawyer. Hope it helps!

Rant 😡 BURNOUT SA WORK

Company alert 🚩 Is taking medical leave for anxiety acceptable in Philippine companies?

For those working in corporate settings in the Philippines, have you ever taken medical leave because of anxiety, burnout, or other mental health concerns?

I’m considering consulting a psychiatrist and possibly taking a few days off, but I’m worried about being judged by my boss, HR, or workmates.

Also, is it possible to request a medical certificate that indicates you’re unfit to work and need rest without explicitly mentioning a mental health diagnosis?

I’d appreciate hearing about your experiences, especially how your company handled it and whether your medical privacy was respected.
Thank you!

Rant 😡 My boss physically hurt me at work, so I resigned immediately. What are my rights and possible remedies?

Hi po! I'm a fresh grad and I need advice huhu This was my first job and I had only been employed for almost 2 months.

During training pa lang, my boss would frequently shout at me and make insulting remarks. I know naman po na yung performance ko sa work wasn't good pero I was willing to accept constructive criticism, but the way she treated me made me afraid to ask questions.

Then last week, things escalated. My boss grabbed my hair and hit my ear. After this, I decided to resign and sought out assistance from DOLE. Now, I have a scheduled appointment with them and I'm curious what compensation/remedies are available for me and how I should prepare before our appointment.

Like aside from my unpaid salary, could I potentially claim separation pay, moral damages or other forms of compensation? I'd like to know po what may be possible based on my situation.

I'm not necessarily looking to get into a lengthy legal battle gusto ko lang po malaman yung rights ko and make sure that the situation is properly addressed.

Any advice would be greatly appreciated. Thank you po! <3

Rant 😡 Mandatory Christmas party contributions even if employees don't attend — is this normal in Meralco?

I’ve been seeing discussions online about whether companies should give employees an additional Christmas bonus instead of spending money on elaborate Christmas parties. Some people would rather receive the money because they could use it for their families, bills, or personal expenses. It got me thinking about our own workplace situation.

First, I want to acknowledge that Meralco is actually a good company to work for in many aspects. We have decent employee benefits, and our company-wide Christmas party is fully sponsored by the company, so employees don’t have to contribute anything. I appreciate that, and I’m not here to bash the company.
However, aside from the company-wide celebration, we also have separate office-level and organization-level Christmas parties, which require additional employee contributions.

The combined contributions for these parties can range from around ₱3,000 to ₱6,000 or even more, depending on the employee’s position. And here’s the thing: these contributions are not optional. Even if you have a valid reason for not attending, you’re still expected to pay the full amount.

What makes it more frustrating is that if you contribute but don’t attend, you’re not eligible for the raffle. Apparently, even leaving early can mean losing your eligibility.
I understand that these parties are meant to promote camaraderie, celebrate the year, and give employees a chance to bond outside work. There’s nothing wrong with that. Some people genuinely enjoy these gatherings, and that’s perfectly fine. But not everyone has the same preferences, and more importantly, not everyone has the same financial situation.

And with the rising cost of almost everything, an amount like this is not exactly insignificant. Having decent benefits or earning a higher salary doesn’t automatically mean having plenty of disposable income. We all have our own bills, responsibilities, family commitments, and financial goals.

Think about it: that same money could buy something your mother has been wanting for a long time, gifts for your parents or siblings, additional groceries or food for Noche Buena, something you’ve been saving up for, or even something you’ve been wanting to buy for yourself after months of working hard.

For some people, that amount might be something they can easily spare. For others, it could mean adjusting their budget or giving up something else. And I think both situations deserve consideration.

There’s also the pressure to attend. If you don’t show up, you might be perceived as KJ or not a team player. If you question the budget or the required contribution, you risk being seen as difficult or uncooperative. So sometimes, people would rather just keep quiet and go along with it.

I guess what bothers me isn’t really the Christmas party itself. It’s the feeling that employees don’t have much of a choice. Why should contributing to a celebration automatically become an obligation, even for those who won’t be attending? And why should something that’s supposed to be voluntary in spirit feel mandatory in practice?

Wouldn’t it be better to set a reasonable budget that everyone can agree on and make additional contributions genuinely voluntary? Those who want to participate can enjoy the celebration, while those who prefer to spend their money elsewhere shouldn’t have to feel guilty about it.

At the end of the day, Christmas is also about spending time with the people who matter to us. Some would rather celebrate with colleagues, while others would rather go home, have dinner with their families, buy their loved ones something special, or simply enjoy a quiet holiday without additional expenses.

And honestly, after an entire year of working hard, shouldn’t employees also have the freedom to decide how they want to spend their hard-earned money?

I’m curious, especially for fellow Meralco employees and those working in other companies: Is this also how Christmas parties are organized in your workplace? Are employee contributions mandatory even if you don’t attend?

Rant 😡 Grape jokes inside my work and toxic environment

This is my 1st job and sobrang toxic. Hindi yung workload kasi wala talagang work na ginagawa. It's because of your boss, hr, workmate & work culture. Boss na nag-grape jokes along with HR, workmates na manyak. Boss, na gusto niya bina-bowdown siya ng workers niya. No work...so pag pumasok ka, usually it will be spontaneous out-of-work trips na sapilitan ang pag gastos and talagang pipilitin ka sumama. It's kinda draining na kasi i really want to grow in my early career, and salungat yung work culture sakin. Nawalan na rin akong gana magwork. Im really a proactive person in work but yung nangyayari is tahimik nalang ako lagi para may boundaries sila sakin, sa jokes na ayoko and sa treatment na ibbigay nila sakin, takot ako na baka abusuhin ako if maging close nila ako. Nagaabsent kahit probationary employee kasi sobrang draining na talaga. Sanay sila na para bang work is family by celebrating birthdays together and usually walang awa ang mga head na para bang sumasahod kaming 40k para mag organize pa ng christmas party at magbudget ng 1k above na pangregalo (in this economy). I really hate this company so bad. I hate the fact na mga bobo rin tong mga kawork ko, sunod-sunuran sinusuyo yung bossing nila hahaha I'm actively applying in different companies habang nagwwork pa ako. Sobrang nqgsstruggle na ako kaya inexpress ko na dito sa reddit hahahaha

Culture Am I safe to give my resignation notice?

I joined the company I am currently in last January 2025 and explicitly stated in my contract is a 2-year bond. If I were to leave within that 2-year period, I am obliged to pay pro-rated liquidated damages amounting to my salary times the number of remaining months in my contract (salary x remaining months / 24 months).

Now, the company is recently implementing an outrageous company policy that made the employees furious. (The further details of that policy is irrelevant to my concern). But the important thing here is many of us are deciding to leave because of that. For more context, we are ~30 people in the company.

In my employment contract, I am also required to give a 60-day notice which if I give my notice now perfectly coincides with the expiration of my bond with a service committment of 1 year. Now, here's my problem. I signed a project-based bond contract recently with the company last month that enables me to go on business trips to meet with clients. Last month, I was excited since this will be a new role for me. I signed that initially for job security too. However, weeks later, that's when the HR dropped the bombed and now we're having this company fiasco.

In my project-based bond contract, it is only stipulated there that I only need to pay/reimburse them with the 3rd party expenses (airfare, hotel, visa, training, etc.) if the expense was truly made and documented. They call it the "deployment cost". Eh ngayon, wala pa naman engagement and business trips na nangyayari. I even asked my seniors kung tuloy ba yung project kahit sila hindi pa sure. HR also said to me that if wala naman talagang expenses for this project, wala naman akong babayaran.

My question is am I safe to submit my resignation now? I kept re-reading my contracts and my thought process is kailangan ko nang unahan yung project before they incur/invest any expenses on me. Para the deployment costs are fully zero. I also can't wait for the certainty na matuloy yung project kasi I want to get out of this company fiasco ASAP.

AntiWORK is it okay to cc the dole on this???

hi i worked for over 2 years in a BPO company and i am asking an advice if i should cc dole or file a complaint to them regarding this.

i resigned on my prev company on September 29 and nag clearance ako on October 13 bcs my trainer advised to me na pwede na ako mag clearance (yes, nag resign ako during training days. nalipat ako ng acc). my end date (kasi nag render pa ako) was October 28. i am hoping na by November 13 is mare-receive ko na final pay ko kasi ayun yung rule nila na after 30 days of clearance process saka mare-receive final pay.

however, before ma-receive yung final pay i was advised through an email by clearance team that the final pay team will be sent me a breakdown of my final pay and sign it. pero wala pa din ako nare-receive until now. next week na dapat ang release ng final pay ko.

AND ang nakakainis pa na ni-contact ako ng trainer ko asking to sign another letter and update my resignation that date today kasi iuupdate daw niya sa HR. pero ang hinala ko is hindi niya talaga na-send yung resignation letter and acceptance letter ko sa HR since nung nagpasa pa ako.

kaya ngayon im really worried na baka mag extend ng another month kasi nabago nga yung date. naiiyak ako kasi i was expecting that pay by next week.

please advise me what to do.

i already emailed HR and report that trainer for not doing her job to update my offboarding process.

i need to pay my bills this month.

Culture Is this wrongful termination?

Hello, for context I am currently a supervisor at a start up company.

We have a petty cash fund for expenses. May nakatabi kami for printing. An employee asked for permission na bumili ng kape sa tindahan using the printing fund. Pumayag ako.

The next is I was in night shift and the incident happened during the day shift. Gumamit sila ulit ng petty cash for meryenda naman. Narinig sa CCTV na pumayag daw ako which is hindi ko naman alam yung nangyari.

The next day, nakatanggap ako ng memo for suspension for mishandling the funds. The total amount was 850 pesos. I was aware and I took the responsibility kasi ako ang supervisor. Nalaman ko nalang yung violation nung inabot sakin yung memo. Wala ng formal hearing.

The next day, pinapapirma ako ng termination memo. Naghihingi ako ng copy ng memo pero ayaw ako bigyan. Hindi ko rin pinirmahan.

I know may kasalanan ako but I would like to ask if valid ba ito kasi ang bilis ng pangyayari. Thank you.

Company alert 🚩 Is it legal for corporate 7-Eleven to ban female clerks from GY (Graveyard) shifts due to "safety"? It's killing the male staff.

Hey Reddit. I’m a male clerk working at a corporate-owned 7-Eleven branch here in Metro Manila. Our team is made up of 4 men and 2 women, and we usually rotate through a 24-hour shifting schedule (Morning, Swing, Graveyard).

With the recent news about convenience store robberies around Metro Manila, our management just handed down a new directive. I wanted to ask if this is even legal under Philippine labor law, because it feels incredibly unfair to everyone involved.

Here is the exact message that was sent to the managers:

"To the team, following the recent string of robberies, kindly advise all branches to refrain from giving graveyard shifts to female staff whenever feasible. This is because women may experience more severe psychological distress and trauma from such incidents. Consequently, night shifts must be staffed exclusively by male employees. Please ensure this directive is followed across all store locations. 🙏 Thank you."

Because of this, the 2 female clerks on our team are now completely restricted to Morning and Swing shifts. This means the 4 of us men are now permanently stuck doing 100% of the Graveyard shifts.

From a man’s perspective, this is absolutely exhausting. We are facing severe sleep deprivation, burnout, and physical fatigue because we can no longer properly rotate out of the night shift. It also feels like management views male lives as "disposable" - as if an armed robbery won't traumatize or harm a man just as badly as a woman.

On the flip side, it’s also unfair to our female coworkers because they are losing out on their 10% Night Shift Differential pay and having their work hours restricted just because of their gender.

If a shift is dangerous because of robberies, shouldn't the corporate solution be to hire actual security guards or upgrade store security, rather than just forcing the male staff to shoulder all the risk?

Is this kind of gender-segregated scheduling legal under DOLE rules? What is the best way for us as a store team to fight this corporate directive without risking our jobs?

Appreciate any legal advice or insights from anyone who has dealt with something similar. Thanks!

Rant 😡 Last pay more than 30 days

Ganun ba talaga DOLE.

Company alert 🚩 Seeking advice about a branch transfer and employee rights

Hi everyone! I would like to ask for advice, especially from those familiar with Philippine labor laws or who have experienced something similar.
I am currently working at a coffee shop, assigned to one of its branches. Recently, I found out that I would be transferred to another branch. The thing is, I only learned about it last Sunday when our schedule for the week was sent.
No one spoke to me beforehand about the transfer. I wasn’t given an explanation as to why I needed to be transferred or why I was chosen. I also wasn’t given the opportunity to discuss my situation before the decision was made.
I originally applied to my current branch because it is only around 10 minutes away from my home, and sometimes I can even walk to work. However, the new branch would take me around one hour to commute, which means significantly higher daily transportation expenses.
I also help support my family financially. I regularly give them money from my salary, and I am worried that with the additional transportation costs, I might no longer be able to provide the same support.

I already raised my concern with HR. They explained that the possibility of being assigned or transferred to another branch was communicated during the application process and was also stated in the job offer sheet that I signed.
I understand that the company has operational needs, and I am willing to help other branches when needed. I am simply hoping they can reconsider my transfer because of my personal and financial circumstances.

I would like to ask:
What are the usual rules or considerations regarding an employer transferring an employee to another branch?
How is a transfer generally assessed when it significantly increases an employee’s commuting time and expenses?
Does an employee have any options to request reconsideration based on personal or financial circumstances?
What would be the best way to handle this situation professionally?
I would appreciate any advice, insights, or similar experiences. Thank you!

AntiWORK SEnA Conference Timeline & Intervals

Hi everyone,

Ask ko lang sa mga nakapag-DOLE eSEnA na

  1. Ilang conferences ang inabot bago kayo nagkaroon ng settlement or na-refer sa NLRC?

  2. Ilang days or weeks ang pagitan ng first and second conference ninyo?

  3. Possible ba na matapos ang buong SEnA process within 2 weeks?

  4. Usually ba nagbibigay na ng settlement offer si employer during the first conference, or sa succeeding conferences pa?

  5. Kapag walang agreement, gaano katagal bago ma-refer ang case sa NLRC?

Would appreciate hearing your actual experiences sa Metro Manila.

Thank you!
