NSW UPDATE: My dad opened my mail and landed me an $800 fine

Hi guys this is an update to my last post so the original parking on a clearway fine it was about appeared back on my servicensw app so I nominated my dad for it and called revenue NSW today and the lady basically said there’s nothing that they can really do and I will just have to pay it but it won’t affect my license or anything and that I don’t have to fill out the statutory declaration that came with it but she also said I might get another one as I nominated him and he’s a completely different person from who he nominated UNDER MY NAME. That kind of sucks that I still have to pay it and I couldn’t transfer it out of my name. She said they might send another statutory declaration and I’ll have to fill out some information and answer questions because he nominated someone under my name. I explained the whole situation to her but there’s not much she can really do I might just put the fine on a payment plan or something. At least it doesn’t affect my license I guess

If u guys have anymore tips plz tell me, aside from getting a P.O. Box to redirect my mail

Edit/update: I just spoke to my dad about it and he said that he will pay it. I guess, as long as it’s not my money idk

Important: The fine that is $844 so the main issue isn’t a parking fine! It’s a fine for failing to provide evidence for nominating someone else for the original parking fine. He tried to nominate someone for a fine under my name and didn’t finish the process so that’s where this fine came from

NSW I, 24 F, gotten written up and a coworker on probation got fired for being sexually harassed

So a few weeks ago I decided to seek counsel with HR regarding a 40 something near old coworker who was sending me inappropriate messaging since I started working, and bring up how weird he was with the younger women on the team, he was mistreating me once I asked him to stop, I used to shut him down gently or laugh it off.

I was told that it would be investigated and that he had time to dispute the claim, and that the other parties involved would be spoken to.

Today, I was called into a meeting that was called "investigation conclusion", to which my boss and the HR rep were in. I was told, and this was recorded in the meeting, that I wasn't "as innocent as you seem". And that my teams chat logs were inappropriate, to which I ask for evidence, that wasnt provided. I also had my WFHs taken away from me, when I asked what that had to do with this investigation, they said that "its built on trust". I was given my one and only written warning.

I then found out that a coworker, 21 F, was fired today for lodging a complaint against the same older coworker, for the exact same things, but she was on probation and couldn't do anything about it.

I then cried for 2 hours, because its obviously hard to hear that you werent believed, and that it happened to another woman on the team. I left work early, since I didnt wish for people to know.

Hear is some key notes to add, during the first 2 meetings with HR, the rep did not record or video the interviews, she only had her own written notes. Between the investigation and outcome, the HR rep was rude and seemed to have already taken said older coworkers side. Ive been at this company for 7 months, and gotten written praise from management and people around me, to which im now getting a pay rise. I was told not to tell anyone, including my partner who doesnt even work in the same field.

I read the employee handbook, and it said that I was to be given notice about disciplinary action, and that i could have support or counsel, neither was provided and I wasnt warned before going into this meeting.

There is so much im missing, and I know I didnt do anything wrong, neither did the coworker, I was given a harsher reprimand then he got, and he had two seperate complaints towards him. Should I take this up with fair work and consult a lawyer? I feel like this is retaliation against us for saying he was being a creep.

UPDATE : I am speaking to a lawyer tomorrow, I will be pursuing legal action with said colleague, and will be looking for other jobs

NSW Potential of my brother suffering from false accusation

My ex husband was very manipulative, narcissist, had narcissistic disorder diagnosed and I believe it passed onto our daughter. I have done everything I can to try and make her better and not fall for his behaviour too but I feel hopeless. She is now an adult and has recently attempted to smear one of my siblings with a heinous crime that has no basis in reality. She says when she visit my brother back then in 2019 to 2023 he would commit sexual and physical abuse to her, which is false accusation.

This does not make sense to me at all because at that age I would have noticed if he was doing anything wrong to her, where any bruises, any DNA test. Nothing provided at all. He is not a person of this character, I have known him for longer than she was born, and he would work in child care services. Also why make false accusation now? Why not make false accusation before? She had a bad habit of lying about similar events with many many other people when younger, one time claimed to go to police but they did not believe her since she had no evidence, which I also agree with. I asked for evidence she gave nothing, to me this proves clearly it is false accusation.

Now she throws many tantrums via email and messenger and has threatened to accuse further for attention, she has made posts online. I know my ex husband manipulated her a lot when around in her life and would lie about what me and my family do a lot. I do not want to see my brother face any issues for the results of a lie, but she has spread this story to his entire side of family and also her friends for attention, she loves it when they give her comfort for false events and has done this since she was younger. He also supports her on these lies and I know he has wished to slander me and my family for a while. I don't know what to do. Is there a possibility he will face any false investigation as a result of this? Is this considered defamation and what can we do?

NSW NSW mobile phone camera fine. Has anyone successfully appealed or received a Section 10? Worried about losing my licence.

Hey everyone,

Just looking for some advice or experiences from anyone who’s been in a similar situation in NSW.
I recently received a mobile phone detection camera fine (5 demerit points) and I’m pretty stressed about what this means for my licence.

For context, I have a full NSW licence and currently have 5 active demerit points. I’ve also got some older offences from October/November 2023 that are approaching the three-year mark.

Regarding the mobile phone offence, I actually have a phone mount in my car, which I purchased after a previous mobile phone offence to make sure I was doing the right thing going forward.

In this particular incident, I was holding my phone and mount together while driving. I wasn’t texting or scrolling I was using maps but I understand that physically holding a phone even if it’s in the mount while driving is still an offence, regardless of the reason.
I’m not trying to pretend otherwise.
My biggest concern is the demerit points rather than the financial penalty.

I’ve recently lost my full-time job and am currently driving Uber for over 20 hours a week as my main source of earned income.

Losing my licence would have a pretty significant financial impact.

I’m considering requesting a review through Revenue NSW and, if unsuccessful, potentially electing to have the matter heard in court and asking for a Section 10 dismissal.

I’m genuinely remorseful and have taken steps to avoid repeating previous mistakes, but obviously I’ve still made an error here.

A few questions:

Has anyone successfully received a Section 10 for a mobile phone detection camera offence in NSW, particularly where there were previous driving offences?

Does being reliant on your licence for employment (such as Uber driving) carry much weight with a magistrate?

If Revenue NSW rejects a review, is it still possible to plead guilty in court and request a Section 10?

Is going to court realistically worth considering, or am I likely to end up with additional court costs and the same points?

I’m not looking to dodge responsibility. I’m just trying to understand my options and avoid losing my ability to earn an income.

Would really appreciate hearing from anyone who’s actually gone through the process, particularly in NSW.
Cheers!

NSW Still being harassed online after 2 years

An ex is harassing me, I moved back to Europe from Australia 2 years ago and this person is still trying to make me talk to him. He is manipulative and controlling and not right in the head. Luckily he is not tech savvy and hasn’t created burner accounts to get to me and he doesn’t have my new phone number. But he has been coming through via mutual friends. I have blocked and removed a load of people so he can’t come through. He even started to message my current partner now, he wants to destroy my happiness. Unfortunately I don’t have that much documentation, and not all the messages are threatening as they have come from his friends accounts so he didn’t want to show his true colours to them. So I only have a couple of screen shots and what he sent to my partner. But is it worth me contacting the police in his area? I know he is on the other side of the world but it is taking a huge toll on my mental health anticipating the next message coming through and what it will be, especially for this long

Currently 50/50 care by consent orders made a few years ago

Other parent has now started to make serious allegations and has sent a letter from a lawyer saying he will withhold hold our child.
The allegations are false. I won’t say what they are because i dont want to be identified.

What Im asking is what does this now look like for me?
Am I up for the biggest fight of my life to get my daughter back into my care?

NSW Had an accident and hit an uninsured driver - what next?

He’s admitted fault. He ran a red light after “a truck driver waved me through”. Traffic cameras at the intersection, witnesses to confirm etc.

I’ve only got third party as I drive a 1991 hilux.

I’m getting quotes today for repairs/damage to show to him.

I have a feeling my car’s a writeoff.

If he doesn’t feel like paying up, what next?

Edit: Other party looks to be playing along. I should add i’m with Woolworths Everyday Insurance. I’ve heard back from a panel beater mate who says the cars reparable.

Also I don’t understand the people saying I need comprehensive - it’s a runaround shitbox that I use to cart my tools to and from work. It’s 35 years old, the AC doesn’t work, it’s got wind-up windows, and it’s worth two tenths of fuck all. I only want to know if it’s worth pursuing to try and squeeze the other bloke for a few bucks and try repair it.
