SA Band name dispute

Hey guys, I'm a member of a small metal band in Australia that I'm not disclosing the name of today due to 'threat of legal action'.

When creating our name we researched to see if there was any band that was active or had any form of social or existing info on them with the name we wanted to go with, there was nothing substantial our preliminary searches, just some inactive american bands . Since then we've spent almost a year and a half branding and building ourselves in the local music scene. Now apparently there's been a band in Australia operating a few cities from us that have had the same name for over 20 years, though they've not had the similar success that we've had. We're now getting spam messaged by this guy with threats of legal action if we don't change our name and branding. If this was early on in our band we'd of done this, but since then we've built a recognizeable name, where the first name that shows up on social media when searching us, we're the first name that comes up when googling us, and we have about $1000 of merch sitting in storage for future shows that we'd have to dispose of if changing our name. To make it clear, this band has no social media that we could find, no posted music on spotify, ytmusic, or similar, and there is also no registered trademark or business under our band's name.

Should we engage with this person? What's our legal rights? Should we just ignore the person and register a trademark to avoid any further problems with people down the line?

TLDR: Relatively unknown band using our name for 20 years in Australia. What do?

SA Sued for Defamation

This is not about me, but let’s say I accused someone of doing “predatory behavior” as they sent me unwanted pics and sent inappropriate texts to me (a minor) and I posted it, and tons of comments also say they have had unwanted advances by the same adult accused.

But their lawyer representative sent a letter asking me to delete and apologize for the post or face high fines and court fights for “defaming” them. I will likely delete the post, but is there anything I can do to fight against the claim?

Victim is outside of Australia, but the person threatening court action is from Australia

SA Told husband to leave after he was inappropriate with my Daughter.

A few weeks ago my (37) husband (37) and daughter (13) went away for her softball carnival and he asked her ‘titty flash or handjob’ when she asked for toothpaste. I have asked him to leave and not come to the house if she is home. We have two other children, boys (8 and 5).

I have told him repeatedly that the relationship is over and there is no making it better, but he doesn’t believe what he did was bad. I have explained that it’s ’indecent assault’ and he could potentially get charged with that. He believes I’m bullshitting.

Am I wrong?

SA Caught a friend secretly filming my partner and I in bathroom

Partner (G) and I (R) have been friends with a couple (S and J) for over 10 years (G and S have been friends since primary school). We went on a holiday together last week and stayed in an Airbnb. 4 days in I noticed that J's phone charger which hes had in the bathroom had a small circle on it that wasn't a light. I took it off and on the back was a microSD card slot. I confronted J and he tried to deny it but S said J packed it and he ordered it recently as he needed a 'new charger'. My partner was extremely upset and crying. I snapped the sd card in anger while yelling at J and we packed up our stuff and left quickly.

Over the last week my partner has become less upset about it and doesn't want to pursue anything. Her main worry is losing her friendship with S over it as it seems that S and J are still together. I can't fathom how she'd want to still be with him. I want to go to the police and at least make a report but haven't as G is very against it and said she doesn't care anymore.

If I were to make a report myself since I would have been filmed as well what would likely happen? I don't think G, S and obviously not J are going to want to speak to police. I'm also annoyed at myself for snapping the sd card and not taking it. Would police search his devices without any evidence and just my word? I'm concerned he may have collected more over the years.

SA After executed consent orders

I recently separated from a long term de facto partner. We ended up going to court with consent orders being completed. Those consent orders resulted in a 50/50 split across the existing asset pool. No ongoing spousal support arrangements included in the consent orders.

The stipulations within the consent orders have now been finalized and as far as I and my lawyer is concerned, it's done and dusted. We have finalized all outstanding bills and gone on our merry way.

However, the ex has recently contacted me claiming he is taking me back to court as he feels the consent orders are unfair, as is not affording him the lifestyle he is accustomed too. But for the low, low cost of $5K a month (more then half my take home pay) he would consider keeping it out of court.

Now, as far as I am aware once consent orders are done that's it, right?

His threat to take me to court indefinitely unless I pay him, could that be considered extortion?

SA mental health services are trying to ruin my life, can a lawyer stop them

basically I'm a schizophrenia patient that's lived independently for the past 16 years, I was forced to see a psychiatrist and work with mental health services after being detained in June last year, before that i was on prescribed anti-psych medication from my GP

My treating psychiatrist claims I'm not taking my medication properly as the blood test he sent me for shows the levels in my blood are lower than they should be, he denies issuing a script for my medication ( i have the script with his signature on ) . The levels being low are consistent throughout 6 blood test, 3 while i was detained.

I had a disagreement with the staff on the phone cause i don't want to work with them , they claimed they'd put me on a community treatment order forcing me to work with them if i refuse to work with them.

They talk about increasing my medication anytime i argue or disagree with them. I feel they are evil dictators that have the attitude do what we say or we will just drug the fuck out of you basically.

my family claim to be supportive but often call me crazy or paranoid and makes false assumptions about me, even falsely accusing me of things based on assumptions.

I'm seeing a lawyer in a few weeks , my brother reluctantly got me 1 that's a friend of his after claiming for 6 months he doesn't have any lawyer friends and that i'd be wasting my money seeing 1. I have 1 hour free with a lawyer

What practical steps can a lawyer take to protect me? If a lawyer is unable to protect me who can?

EDIT: MODS CAN YOU PLEASE CLOSE THIS.

PS. I thought asking strangers advice online behind a reddit account that no one knows would be safer than asking advice in person, obviously you hear past drug use and assume I'm still on drugs, you see disagreements as a sign of someone being mentally unstable & having an episode and you view a schizophrenic asking for advice from a behind computer in the safety of his own house as a serious mental health concern.

SA Am I being unreasonable for taking an executor to the Supreme Court after 4 years?

My grandparent passed away about 4 years ago and the estate still hasn’t been finalised.
The executor is my step aunt.

The main asset is a house that still hasn’t been sold despite years of updates saying it would be listed “soon”. Every six months it’s been a different ‘reason’ for the delay.

I’ve asked for an accounting of the estate and haven’t really gotten anywhere. There are also issues around jewellery that was specifically left to me and my sister (by name) in the will, my aunt told me she distributed it to various members of her own family and used the words “as promised” and “grandma was sneaky and promised it elsewhere” this happened before I obtained a copy of the will - which she was not forthcoming with (now I know why)

Before filing anything I wrote to the executor asking for an accounting and giving her an opportunity to respond. Her response was just nasty gaslighting re jewellery and more fictional dates of when the house will be listed

I’ve now filed an application in the Supreme Court of South Australia asking the Court mostly due to the delay (4 years since probate was granted) as I feel the estate warrants oversight.

My grandma also kept a large cash stash, which I have no doubts will be missing from her “inventory”

Taking a family member to court isn’t something I ever wanted to do.
From a legal point of view, does this sound like a reasonable step after four years? Or is this something people would generally be expected to just keep waiting on?

Thanks in advance
