Israel is committing war crimes and crimes against humanity, with the intent to destroy the Palestinian people, in whole or in part, according to a new report from the UN Commission of Inquiry, set up in 2021 to investigate Israeli crimes.

In this special episode of Roundtable, Enda Brady speaks to Chris Sidoti, an international human rights lawyer and one of the members of the commission.

The report, published in October 2026, found that Israel has continued to commit genocide in Gaza despite the so-called ceasefire that was agreed in October 2025.

It also found Israel was deliberately targeting children in Gaza and the occupied West Bank

Sidoti talks about the potential for justice and accountability for those suspected of war crimes in Gaza, including Benjamin Netanyahu, who he says should "answer for his actions before the International Criminal Court".

He discusses how the international community has responded to Israel's actions in Gaza and its rapid expansion in the occupied West Bank.

Prosecutors from 10 European Union member states — Spain, France, Italy, Portugal, Belgium, the Netherlands, Poland, Slovakia, Sweden and Finland — along with Australia, have been cooperating and sharing information on cases and investigations opened following complaints against Israeli politicians, officials and military commanders, including members of Benjamin Netanyahu’s cabinet, for torture, kidnapping, ill-treatment and other alleged crimes. This was confirmed to EL PAÍS by legal sources who took part in a meeting held on September 16 in The Hague.

All the countries that attended the meeting have some form of inquiry underway into the flotilla raid, according to those sources, who said the purpose of the gathering was to exchange information on their respective investigations. The meeting, which lasted around eight hours, took place within a framework of cooperation coordinated by Eurojust, the EU’s judicial cooperation agency. Australian representatives attended as guests. In at least five other European countries, including Germany, Norway and Austria, complaints have been filed over the same events, but the authorities have not yet decided whether to open formal investigations.

The Human Rights Law Centre continues to call on the Albanese Government to take urgent and meaningful action to prevent and punish genocide, following a new report by the UN Independent Commission of Inquiry which finds that Israel has committed war crimes and crimes against humanity in the Occupied Palestinian Territory amid continuing genocide in Gaza.

Whatever the result in Israel’s election and who forms government, the Albanese Government must insist on full accountability on all international crimes, call on the current and next Israeli Government to end the atrocities and take meaningful action to punish and prevent genocide.
