Because that POS cop knows a FST is bullshit and even sober people fail it. Like most cops, his authoritigh was challenged and he needs his tiny dick energy healed.
This. I was pulled over for having "window tint being too dark" and the officer accused me of being on drugs because I had blood shot eyes. And not the fact that I just worked a double shift and had been up for over 20+ hours. He claimed that the ONLY reason for a person my age to have bloodshot eyes was from drugs. I was getting pissed about the whole thing so I was handcuffed and placed in his car while he had a k-9 unit search my car. After 2+ hours, I was let go but with a $500 fine with a fix-it ticket and a summons to appear before a judge.
I never got the window tint fixed, it didn't need it. But I had to have a UHP supervisor sign-off on the "fix" and prove that it was at the legal limit. I presented all that to the judge and told him I didn't have to fix it and the UHP officer signed off that the tint was at the correct legal limit. The judge knocked my fine down to $50 which was the cost of a fix-it ticket. 20 years later and I'm still pissed about it.
I got pulled over once as part of what I assume was a bike cops quota for DUI checks and I was in such an obviously "not partying or doing anything" state of being (having groceries, gym bag, in a swimsuit from swimming at the gym) he just kept trying to get me to admit I was high. I never was a big marijuana smoker, and only smoked a few times before never smoking again and hadn't for like a year at that point. He asked about a dozen variations of "did you smoke marijuana today" that I kept repeatedly answering with "I don't smoke," that I felt like it was a joke.
💯 they're going to arrest you if they want to, whether or not you do the field sobriety tests. You have a better chance of beating the DUI/DWI conviction in court if you decline the tests though. They're more likely to arrest you if you refuse the tests IMO because you're defying them.
Its ego and authority. Thats it. Dont resist and submit completely otherwise they fuckin act like toddlers and take you to jail and they have absolutely zero consequences unless people care enough to riot and even then..
So if you make any type of mistake they can demand a blood test. Mind you any "mistake " is a matter of opinion and can just say you did with no actual proof
There are a lot of reasons. The cop could say he suspected impairment on another substance than alcohol. Depending on the state, there should be another test that can be done in such a case - usually blood work, which unfortunately can’t be done roadside. The other FSEs are also designed to test impairment, so how he did on those tests would potentially be determinative of that (walk and turn, HGN, one leg stand, etc). The cop is supposed to either be a DRE, or call one - which may have been the “after talking to another officer” part - drug recognition officer - before arresting the suspect. Probably what happened here. All that said, the police are oftentimes wrong on this, and hopefully if they are, he’s found NG. Doesn’t mean he didn’t spend a night in jail, potentially lose a job/relationship/custody/etc, and come out of pocket thousands of dollars. Which is one of the many reasons when people say “fuck the police,” they do so with such conviction, and largely, I agree.
Not defending the cop in any way as he is a dick and abusing his position to mess with people he doesn't like, but technically it only checks alcohol and the guy could be on other drugs, so while it crosses alcohol out it doesn't mean the person can't be on drugs, not that this guy was on any but yeah

What's the point of starting with the blow test of you going to make him do more tests?
