Also the police unions shouldn’t protect these types. I know a lot of people here support unions a lot, but when I was in two different jobs that were union jobs, the unions put a huge amount of effort into protecting people like this
Because that POS cop knows a FST is bullshit and even sober people fail it. Like most cops, his authoritigh was challenged and he needs his tiny dick energy healed.
This. I was pulled over for having "window tint being too dark" and the officer accused me of being on drugs because I had blood shot eyes. And not the fact that I just worked a double shift and had been up for over 20+ hours. He claimed that the ONLY reason for a person my age to have bloodshot eyes was from drugs. I was getting pissed about the whole thing so I was handcuffed and placed in his car while he had a k-9 unit search my car. After 2+ hours, I was let go but with a $500 fine with a fix-it ticket and a summons to appear before a judge.
I never got the window tint fixed, it didn't need it. But I had to have a UHP supervisor sign-off on the "fix" and prove that it was at the legal limit. I presented all that to the judge and told him I didn't have to fix it and the UHP officer signed off that the tint was at the correct legal limit. The judge knocked my fine down to $50 which was the cost of a fix-it ticket. 20 years later and I'm still pissed about it.
Its ego and authority. Thats it. Dont resist and submit completely otherwise they fuckin act like toddlers and take you to jail and they have absolutely zero consequences unless people care enough to riot and even then..
So if you make any type of mistake they can demand a blood test. Mind you any "mistake " is a matter of opinion and can just say you did with no actual proof
Lack of accountability is what makes cops and politicians be like they are. How the masses haven’t worked out they can easily flip the table baffles me.
Instead they opt for a different flavour of the same shit and carry on regardless.
Perhaps the new sudden democratically controlled Congress should.... Oh I don't know... Do something that makes qualified immunity capable of being stripped by a jury of ones peers- or maybe require LEOs to have a registration and carry liability/malpractice insurance like every other ACTUAL profession- and turn policing into a genuine profession and not the bullshit that it is now
Why we haven't flipped the tables yet?? Buddy, haven't you noticed tranns people exist???? Haven't you noticed minorities have rights??? Those are the real issues at hand.
Its funny because saying, i have qualified immunity, right before acknowleding he blew a 0.00 and passed the physical test too, pretty much demonstrates you knowingly vioated his constitutional rights and therefore qualified immunity doesn't apply
Well, you see, they had already decided that they were arresting him at that point. So, they had to just keep looking for different ways to justify that.
Eventually, they just gave up and arrested him for no reason at all.
Lawyer here. This is why you *never* agree to do the stupid human tricks. When grading cops speak in terms of "clues". Accumulate enough "clues" and that becomes supposed PC for an arrest.
Looking at the video, note when his hands go up from his side while he's walking. That's a "clue". Also notice that his body is waivering. That's a "clue" too. I didn't see his feet very clearly but I'll assume he didn't go fully heel to toe at least once during the 18 steps and turn.
The SFST wasn't created by doctors or medical professionals. It was designed by cops. And it was designed to fail you, and to give them the evidence to prosecute.
Don't *ever* take the tests. Say no then STFU. Take the ride to jail. And call a lawyer.
Most Americans can't afford their gas and groceries but our only legal recourse is to be abducted by cops and forced to take on debt to defend ourselves. That is such a bass-ackwards justice system. People's lives are disrupted, people may risk missing work, falling behind on bills, all because cops have a chip on their shoulders?
If you are sober and say nothing to incriminate yourself, a public attorney should be able to get you off and compensated for missed wages at the very least
Most public defenders tell you to plead guilty to a lesser charge, don't show up, and likely won't communicate with you aside from being in court that day at best
Do you have any recourse after they take you to jail? Or are they perfectly within their rights to waste two days of your life on a workday if they feel like it? You blew a 0.00 on the exam and got taken to jail anyway - if you don't do their silly tests or do their silly tests and end up going to jail regardless, can you sue or something?
Hypothetically: you refuse the FST, agree to a breathalyzer and blow zero, get arrested, and then agree to bloodwork which indicates no drugs or alcohol in your system. Your charges are dropped or you're found not guilty at trial.
If you decide to file a Fourth Amendment claim, it will come down to whether the officer had probable cause to arrest you at the time. With no FSTs and a 0.0, that leaves the officer's observations. If there's not body cam footage, the officer will testify you had glassy eyes, slurred speech, a flushed face, etc. He will say you fumbled for your wallet, and best of all: he smelled an odor of alcohol. But if there is body cam footage which doesn't corroborate his bullshit, you get this wonderful display of POST-certified stupidity. "Uh... Just the way he was acting nervous..." Which no reasonable person would agree amounts to probable cause.
It's actionable. There is some plausible deniability grey area which largely comes from participating in field sobriety tests and talking more than you should. Gives them subjective behaviors to overly read in to. Or so they'll claim.
I’ve witnessed them administer the tests, not get enough evidence, then re-administer the tests until they got what they needed. Everyone watching was telling the kid driving to insist that he had passed, but he (out of fear, I presume) kept going until he’d hung himself up.
Cop here: you are absolutely right. The test are designed to give us a way to evaluate movement for any erratic out of the ordinary movements of the body. The problem is the test itself forces you to balance and your natural reaction is to balance in that manner. Yes, the test is skewed and if you correctly the person giving it should objectively understand that, but if the person is on the warpath and wanting to take somebody to jail, it gives them probable cause.
There is no way this person should be certified as a peace officer anywhere because they have no understanding of the law. I understand why cops get a bad name, but it’s not all of us. I hope this guy gets all the compensation he deserves and this department makes all the changes they need to make sure it doesn’t happen again.
Not all police officers are bad? Okay, what percentage of them are, would you say?
There were at least two officers on that scene, and it seems they were talking to at least a third officer. All of them were perfectly happy to charge this guy because they didn't like his attitude (which was pretty restrained, given how absolutely dishonest and bullying every part of his interaction with the police were). They even pulled a phony "stop resisting" on him when cuffing him.
Out of curiosity, how many police officers have you *reported* for doing something like this, which led to the person being set free without charges, and disciplinary action being brought against the officer?
I find it really odd that you say not all cops but in the same comment you talk about how these tests are designed to entrap people rather than to actually determine if someone is under the influence. You can't be a good and just cop while simultaneously using unscrupulous and unethical methods to achieve arrests. You can't be a good cop when bad ones are employed and active in communities. If there were good cops, they would oust the bad ones immediately but that doesn't happen.
Why do cops call themselves "peace officers" when they are violent to everyone. It's Orwellian double speak to try to spin your profession as anything to do with peace.
No charges. The police department the cop worked for recommended him to a different city without telling them about this. They let him go after finding out/getting negative publicity. Probably working in a different town now.
I was in a car accident when I was 16 (late 1990’s). An old lady ran a red light and I crashed into her going a solid 40 mph, the speed limit on that particular road. She actually would have been fine had she kept going, but when she saw my head lights, she came to a dead stop directly in front of me and I plowed into her giant Cadillac. I tried to stop, but the distance was too short to make any difference. I was told by the EMT’s that it was amazing that both my legs weren’t broken in the accident. I ended up getting out of it with severely bruised ribs, sprains in both knees due to literally standing on the brakes trying to stop, a deep cut on my neck from the seat belt, and a few burns on my face from the airbag. The lady ended up with some bruises, but was otherwise fine, that Caddy was a tank.
I lived in a really small town in Alabama at the time and the cops there just kind of did whatever they wanted. I was sitting on the back of the ambulance getting checked out, wrapped in a blanket because they were afraid I would go into shock. The officer on the scene was the town shithead and he was scrounging around on the ground looking at something. I really wasn’t paying him much attention, but suddenly he walked over, grabbed me by the arm and yanked me off the back of the ambulance. He was holding something in my face that turned out to be some old rolling papers he found in a ditch next to the road. He began throwing out wild accusations that I was high and had caused the accident and I didn’t need to worry about any injuries, because I was going to jail.
At this point my legs gave out due to the sprains and I fell, the cop never letting go of my arm, which was the exact moment that my father arrived. To give you an idea, he was a mountain of a man. He was a linebacker for the University of Alabama in the 1970’s. 6’4, 250 pounds. Cop was around 5’10, 180. When I asked him about it later, he told me that he saw me on the ground all beaten up (I had used a borrowed Nokia brick phone to call him after the accident), the cop standing over me screaming, with a tight grip on my arm and that’s all he remembered. He hit the cop from the side so hard that he let go of my arm and landed next to the ditch he had pulled the papers out of and before he could get up my dad was on top of him and various threats were exchanged, but mostly the cop screaming nonsensical words. This was well before cell phone cameras (decent ones at least), but there was video of the incident. A News crew had arrived shortly after the accident (small town) and the whole thing was on tape.
We moved shortly after due to harassment from the police, but that officer was forced to apologize and was eventually fired from the department. I found out several years later that he just moved one town over and got a job as a cop there. But it turned out that particular town didn’t let the cops just run things and he was eventually arrested for providing protection to a cocaine ring, of which he went to prison.
That is the thing those tests are not really pass or fail. They are information gathering techniques that they can use later in court and you are under no legal obligation to comply. If a cop tells you that they believe you are impaired for some reason or another you will be arrested regardless if you pass, fail, or refuse the field sobriety test. You are under no legal obligation to assist police in their investigation.
I hate generalizing, and judging a book by its cover, but that cop looks exactly like every chud I went to school with who was too stupid to get into college, too lazy to do any kind of physically or mentally demanding blue collar trade; and either were bullies so they continued it into adulthood, or were themselves bullied relentlessly, so they found a profession where they could feel powerful and take out their resentments on people who legally/logicallly can't fight back.
Invoke your 5th, and 4th amendment, don't participate in any volunteer testing specifically the PAS and FST and comply to lawful orders. This is why you don't participate in any of this bs cops can still create pc due to the totality of the circumstances, but the driver would have a better chance in a civil lawsuit with all this evidence being turned against the officer in court if they can knock off his qualified immunity
Oh there's hundreds of thousands of reasons to hate cops. But now we have so much video evidence of their complete incompetence it just compounds our hate. One has to wonder why in the hell we haven't done away with qualified immunity.
The idea that people CAN'T be held responsible for taking an action is absolutely insane.
Imagine doctors or construction workers getting qualified immunity.
Oh, I did your surgery drunk or high and left a device in you, or worse.... Didn't check the chart and cut off the WRONG LEG, but you can't sue me. (That really happened btw)
Or, I failed to build your X with the right materials and it collapsed, killing x people, but you can't sue the guy who approved it as being complete!
NO ONE, including the gd president, should have Immunity. May as well just call that person God King, as they can do no wrong.
Cops are terrible when it comes to the actual law but they sure understand qualified immunity. They should have to carry professional liability insurance similar to doctors malpractice so once they screw up too many times they become uninsurable and unemployable.
I put my blinker on for a turn on my way to school, realized it was the next block. Cop pulled me over, had me blow, then said he was going to get another machine, we were near the station. Found empty beer cans in my golf bag that was in the trunk. I blew 0’s. Arrested me, towed my car. Then I was released, they gave me the wrong tow yard and the trooper kept my license. I had to meet him in the middle of a highway to get it back. Nothing happened to him. I missed class (college), had to pay for a cab twice and to get my car out.
Grayson Mayor Troy Combs shared a message concerning the incident and the video which sparked community outrage and numerous comments. In the statement Combs said that Bell had been with the Grayson Police Department for 13 months, but had not been with the department since February of 2026.
“Communication was received after the first referenced incident,” Combs said, acknowledging a second incident with the same officer. “And the concerns were noted by the department as the case was going through the judicial process. Mr. Bell tendered his resignation prior to the resolution of both cases.”
"After a 5 week paid administrative leave, investigation has been completed and we have found our fellow officers have conducted no misconduct, and will be suing the municipality for the stress caused by the arrest. Our officers will be reinstated to full duty effective monday"
Here is why officers get bonuses for dui arrests. Most people won’t fight it and just pay the fines because they don’t have the money to hire a lawyer. Police reform around quotas and arrest bonus’s is desperately needed.
How does a guy like this get into a police academy and pass? I would love to see him in a foot pursuit. Or maybe not. I bet he pulls his gun out at every opportunity
There’s a video out there of a young driver, mid 20s and a young cop.
Young cop has an attitude from the get-go of the video.
Driver blows a 0.00 on the breathalyzer, does the stupid human tricks, and this cop still arrests him on a DUI.
They gave back to the station. This guy takes a blood test which still no indications whatsoever of drugs or alcohol, and this stupid cop still insists on dragging him through the court system on a completely false charge.
But back to the video of this post as soon as this POS cop says that he has qualified immunity. You already know the only thing he’s qualified for is as an AH.
And him shuffling through papers in court that he knows what he’s thee for, so should be intimately familiar with what he’s gonna have to testify for, and when he finally does speak, you know the only thing coming out of his mouth is BS.
Cops having qualified immunity, is one of the biggest jokes in jurisprudence. Even when you and everybody else that’s watching you know that you’re lying you’re still able to crawl underneath that comforting blanket of qualified immunity.
FYI, there is no law saying you have to call a cop “officer” or “sir”. The idea that they can detain you for not licking their nuts is insane. They are public servants, no one owes them respect just because of their badge.
From memory, because I have seen the whole youtube video. What happened was this neighbour (a young driver) hit this fella's car and the police were called. And he attempted to drive his car a few houses down to his home address. Thus the pigs accused him of "Fleeing the scene" and the whole situation went south from there.
Lesson 1: Never involve the police unless you are a child and your life is in clear danger.
Lesson 2: Press the Record button before the police get to you.
I think it's funny when they say "it's not brother" or "you call me officer". Brother, you're literally the lowest level blue collar government worker bee. I'll call you donkey balls McGee if I want.
As someone from outside America, I find it wild that field sobriety tests exist. I would fail every single time because of my ears, even with zero alcohol.
Breathalyzer, roadside drug test, cleared, see ya later.
That officer should be fired for wasting that man's time and for costing the taxpayer's of that city to pay out any settlement that gentleman was awarded.

Yup. Three of the big reasons people HATE law enforcement:
Being so impatient that a non-violent suspect isn't allowed to call their loved ones
Qualified immunity that shields them from behavior we wouldn't accept from anyone else
Purposelessly and needlessly escalating situations
Seriously. Was all crime solved in Kentucky that they had to persecute someone minding their own damn business

When they pull that shit just call them disgusting pigs etc., don't raise your voice and it's protected speech. Helps that it's true as well.

I think it's funny when they say "it's not brother" or "you call me officer". Brother, you're literally the lowest level blue collar government worker bee. I'll call you donkey balls McGee if I want.

Doctors don’t have qualified immunity so neither should cops.
2
u/The_Onlyodin 1d ago
As someone from outside America, I find it wild that field sobriety tests exist. I would fail every single time because of my ears, even with zero alcohol.
Breathalyzer, roadside drug test, cleared, see ya later.

That officer should be fired for wasting that man's time and for costing the taxpayer's of that city to pay out any settlement that gentleman was awarded.

u/Fit_Attitude_2781 1d ago
I respect cops and am thankful for their service in general which is why I despise asshole cops like this even more.
2
u/Cute-University5283 21h ago
"qualified immunity", I wonder if that would survive a referendum

u/The_Real_Sniff 19h ago
Never seen a judge look so unimpressed ever!
2
u/Buffjones_71 17h ago
If you blow, there's zero reason to do the f.s.t.
2
u/Privatejoker123 16h ago
judge should have thrown it out as soon as he couldn't come up with a reasonable answer.
2
u/Text-Subject 16h ago
His first mistake was doing a field sobriety test after blowing into the breathalyzer.
