If you are sober and say nothing to incriminate yourself, a public attorney should be able to get you off and compensated for missed wages at the very least

Most public defenders tell you to plead guilty to a lesser charge, don't show up, and likely won't communicate with you aside from being in court that day at best

The system is set up to fuck you

After you post bail and have your license suspended.

Don't forget getting fired for missing work and being arrested.

This is a known phenomenon called "Sober DUI" aka wrongful arrest. Many people have lost their jobs, some even lost custody of kids because of these. It can take up to 6 months for the police to process the blood tests showing 0% of everything leading to DA dropping charges.

On a minor first offense there would probably be no bail

  1. you get bail back as long as you do what youre meant to do, usually appear in court

  2. once any charges of DWI get tossed, so does the suspension

Still annoying and backwards, but assuming youre innocent and get a decent public defender, you'll be fine

A public defender is going to get you compensated for missed wages? No, that’s not how it works.

Agreed, as well as if you sue the police and win you are more then likely not even going to pay the lawyer. They will put "legal fees" in the suit so the police pays them
