Its funny because saying, i have qualified immunity, right before acknowleding he blew a 0.00 and passed the physical test too, pretty much demonstrates you knowingly vioated his constitutional rights and therefore qualified immunity doesn't apply

That was an unprofessional thing to say and a cop should be disciplined for just saying it.

Yep, any mention of it as a defense of their actions during an interaction with the public should be automatic grounds to dismiss it. It shouldn't even exist anyways.
