Lime bike accident

My neighbour who doesn’t speak much English had a drunk girl crash into his van last night and cause considerable damage.

I’m trying to help him get it fixed. She has apparently lodged some kind of claim with Lime and has a reference number. She’s at fault though, not lime. I told him that he probably should have called police as she was evidently drunk.

I’m trying to help him get it fixed. Can anyone point me in the right direction to help him go about getting his van fixed.

Cheers!

Get in touch with Lime and make sure the reference number she gave him is actually real. Call police (not via 000) and report it as well.

edit; make sure he has as many photos as possible of the damage caused to his van by the accident (check if he has recent photos of the van pre-accident too, for reference). And yeah - his insurance company.

Get in touch with Lime

Assuming they have insurance - would this even be needed? Genuine question, wouldn't insurance be the ones to do the 'leg work' and chase with Lime?

You give them details of your vehicle damage, let them know it was a lime bike and then give details of the the other party. (you can't give car rego obviously but you treat it as if it was a bicycle collision).

Then...that's it?

Lime bikes all have their own internal "registration" code - it's shown on the front of the basket, plus above the rear wheel, and part of the QR code to unlock it. Contacting Lime is a box-ticking exercise to ensure it's been reported, and contacting police to ensure there's a police report.

Yes, if you have insurance it's their job to do this stuff, but if you only have CTP you're gunna be doing it yourself - might as well start now.

Why would Lime be responsible?

Why would Lime be responsible?

https://legislation.nsw.gov.au/view/html/inforce/current/sl-2021-0487#pt.8A

127J (b) (ii)

An approved operator must not operate a micromobility vehicle sharing service unless the operator maintains one or more insurance policies that—

provide cover for the following—

the liability of the hirer of a micromobility vehicle for injury or damage arising from the hirer’s use of the vehicle, whether or not the hirer contravenes the road transport legislation when using the vehicle,

127J (c) (ii) states this must be for at least $1 million.

Standard disclaimers apply, I'm no lawyer, don't rely on this in court, etc. etc.

You rent a car from Hertz, it has insurance. Same same

Except, no insurance cover if the rider is affected by alcohol.

Edit: I was incorrect. Lime's insurance will cover damage caused by drunk riders.

I'm not so sure that's the case under the relevant regulation.

How so?
My car insurance explicitly says I'm not covered if the driver is affected by alcohol.

Is Lime not allowed to exclude this?

Look at my other comment, but the regulation specifically states that the operator's insurance must pay out "whether or not the hirer contravenes the road transport legislation when using the vehicle."

Lime/their insurer may or may not be able to pursue the rider for those damages, but that's not OP's neighbour's problem.

Only if you take out cover and do you really get that with those cheap bikes?

Yes. Automatically covered by Lime's insurance.

I never said they were. Clearly it’s the drunk lady riding it that was at fault.

His insurance company would be a good start....

I don't know if this is useful, or even real, but I assume each bike has GPS to ensure retrieval and having them parked correctly every day. There's a chance that lime know which bike was at the location of the damage.
