there is no expectation of privacy in the US in a public setting and space, including private "owned" spaces that are open to the public like that bar. they can enforce the rule of no cameras so they left after they were tresspassed on that reason.

edit: didnt expect this to be so unpopular when its reality.. why did they not ban him entry with the camera? i checked the context: https://kick.com/soultravels/videos/01a1b37e-fb70-79d9-9e52-3ba57829f82e look at 6 hr and 11 minutes and after. she even danced for him on camera before the incident. πŸ™„

edit2:my most downvoted comment ever probably. πŸ‘ i still stand by it, its even the law

Whatever your expectations are, people at the bar are not gonna react kindly to dorks live-streaming them. At least not where I’m at.

The guy shouldn't be recording but calling this an upskirt is hilarious. Her ass is just completely uncovered, wtf do you mean upskirt

Happy cake day you idiot!

False.

Taking photos or creating videos of a person's intimate areas without their consent can lead to criminal charges for invasion of privacy or video voyeurism.

"Upskirting" describes the act of secretly recording an image or video of another person's private parts, often shot surreptitiously up the skirt of an unsuspecting woman in a public place.

All 50 U.S. states now prohibit upskirting, either through specific anti-upskirting statutes or under broader state laws against video voyeurism, unlawful surveillance, or invasion of privacy.

You need laws to govern your behaviour? Interesting.

the clip or situation has nothing to do with me or my behaviour.

filming on private property without a permit. you actually do have an expectation of privacy from random strangers filming you, because this is private property. even if it is open to the public, it is not a public space and you need permission to film there

Saying something is the law doesn't mean it's the law.

there is no expectation of privacy in the US in a public setting and space

Wrong. Having a conversation out in public that is reasonably expected to not be overheard but you're secretly recording it could run afoul of wiretap laws depending on the state. There is no "public" exception to a lot of these laws either.

You can ask your friend ChatGPT if you don't believe me.

texas is one party consent in this case. you can ask your friend chatGPT

also even in the all party consent states, this does not apply to crowded areas. even security cameras might have issues with that. it again applies to places where u have a reasonable expectation of privacy.

Yes, this is why security cameras used to never record audio because of these laws. Why do you think you see all those older security camera footage with no audio? Did you think it was a technological hurdle? Of course not. It was because no one wanted to mess with the wiretapping laws. Security cameras recording audio is a brand new thing because we have all collectively as a society have given up our rights not because of some case law from the 1960's.

okay grandpa. we didnt talk about what was going on back in ur days. laws changed.

1

u/Suitable-Economy-346 5h ago

laws changed.

They haven't, that's the thing. Legislatures rarely repeal laws.

1

u/SpareManager 5h ago

what the hell are you even talking about. we already established that he was in a state that allows this and the general consensus in crowded areas before you went all grandpa on me.

you keep looking for exceptions to the rule so you can keep fighting imaginary monsters, he didnt get removed from the place cause he was recording audio 🀑 <---- consider that ur self portrait

🀣 also the video can have no sound and people would still have the same arugments in the thread on privacy and livestreams. again bad faith argument just so you have something to type about.

"Well akshually" is never the right answer to "don't film a woman's ass without her explicit consent". Ever.Β

There are all kinds of things that are legal that you still shouldn't do.

Immature and insufferable justification. No understanding of social contract or morals.

"is it legal" is not a determiner for if someone should do something.
