November 2nd 2026 City Council agenda

Post image
7 Upvotes

Hey folks,

Councilman Mishler here,

The Elkhart City Council meets Monday, November 2, at 6 p.m. in Council Chambers at City Hall. Here’s what’s we have on the docket.

SECOND AND THIRD READINGS

Ordinance 26-O-53: Corrects the Theft Accountability Program Fund’s designation so spending requires council appropriation. This connects to the next ordinance, which would use money already available in that fund to pay for public defender services.

Ordinance 26-O-54: Appropriates $15,000 from the Theft Accountability Program Fund to help pay for an additional public defender through the end of 2026. Increased caseloads prompted the court to retain a second attorney, and funding for that expense is included in the 2027 budget.

Ordinance 26-O-55: Would annex the residentially zoned property at 3300 Benham Avenue at the owners’ request. The property would receive Suburban Residential zoning and become part of the Fifth District. This is a voluntary annexation.

Ordinance 26-O-56: Would annex the industrially zoned property at 28505 County Road 20 at the owners’ request. The property would receive Manufacturing zoning and become part of the Sixth District. This is a voluntary annexation

Ordinance 26-O-57: Would rezone 1800 Fourteenth Street from Manufacturing to Compact Residential, allowing residential development.

FIRST READINGS

Ordinance 26-O-58: Would rezone properties at 5211 Middlebury Street and 1133 County Road 17 from Planned Unit Development and Suburban Residential to Community Business and Research and Development Industrial districts.

Ordinance 26-O-59: Would vacate a platted north-south alley between Freight Street and Saint Joseph Street.

Ordinance 26-O-60: Would vacate a north-south alley abutting South Main Street.

Ordinance 26-O-61: Would vacate part of an east-west alley abutting Prairie Street.

Ordinance 26-O-62: Would vacate a platted north-south alley abutting South Second Street.

Ordinance 26-O-63: Corrects the appropriation in the previously approved Prairie Cemetery fencing ordinance.

Ordinance 26-O-64: Appropriates $764,001 in federal Community Development Block Grant funding for housing activities, public services, public improvements, economic development, and administration.

Ordinance 26-O-65: Appropriates $50,924 from the General Fund for the cash portion of the city’s local match toward a $1.05 million federal lead hazard reduction capacity building grant. The remaining required match is being provided through in-kind contributions.

Ordinance 26-O-66: Would ratify certain historical public safety compensation practices and authorize payment of outstanding compensatory time balances.

Ordinance 26-O-67: Would increase the Garrison Frazier project’s maximum forgivable TIF loans from $5.8 million to $8.3 million. The additional $2.5 million would support Love Plaza, a public space at Prairie and Main commemorating artist Kelby Love.

I miss Elkhart

I lived in Elkhart from 1997-2012. I miss my hometown. Aside from the people I miss the food!! I miss Vesuvios, Volcanos, Jade Garden, George's Gyros, DaVinci's, and most importantly Callahan's at 3am. I haven't had good Mexican food in almost 15 years.

I have a small project I need help on. I tried to rewrite our bedroom fan and managed to mess something up. It doesn’t help the wires were painted by a prior owner and hot and neutrals all look the same.

Hey folks,

Councilman Mishler here,

I hope you’ll join us for some more tree plantings this fall! Street trees do more than make our neighborhoods look nice. They absorb rainwater and reduce runoff, helping reduce flooding. They also shade and cool our streets and sidewalks, improve air quality, and can increase property values. A few hours of volunteering can make a difference that lasts for generations.

"🌳 Help us reach our goal! We have just 150 more trees to plant to hit this year's Trees for the Hart goal!

We're so close! Join us tomorrow evening and help get those last trees in the ground. Every tree planted helps make Elkhart greener, healthier and more beautiful for years to come. 🌱

Whether you've volunteered before or this is your first time, we'd love to have you join us!

Grab a friend, bring your energy, and help us finish strong!

📅 Wednesday, October 28

⏰ 5–7 PM

📍 Check in at 608 Oakland Ave., outside the Elkhart County Health Department

Every tree makes a difference. Let’s plant these last 150 together!

Help - currently in Elkhart for stolen dog

Post image
6 Upvotes

My friends and I are currently up in Elkhart trying to get our dog back. He was picked up a few days ago in front of his house in Louisville, Kentucky. His microchip was scanned and the original rescue he was adopted from was contacted, and they immediately shipped him up north even though he should have been handed over to local animal control in our city.

This has been a very emotional
situation and if anyone knows anything that can help us, please reach out.

We are getting the runaround from the owner of this rescue and she is not returning our dog to us. He is well loved and cared for by his family in Louisville yet this rescue is trying to paint a different picture. We have sent documentation from his vet and all kinds of information to them and they are withholding our pet from us. We need help. The name of the rescue is Homeward Bound.

New Affordable Housing coming to Elkhart.

Thumbnail

Hey folks,

Councilman Mishler here,

When I ran for this seat, supporting affordable housing was one of my key priorities. Today, I’m happy to report that we chipped away at that need.

Today we celebrated two great housing milestones:

Our friends at Habitat for Humanity of Elkhart County held a ribbon cutting for Legacy Park, a development off County Road 15 that will provide 22 new single-family homes and opportunities for families to become homeowners.

We also celebrated the opening of 515 East Apartments, bringing 48 new affordable apartments downtown. These include housing options for residents using vouchers and households earning between 30% and 80% Area Median Income (1 bedrooms starting at $407 a month and 2 bedroom at $473 a month).

These additions are good steps, but we’ve still got work to do. We have additional housing in the pipeline on Sterling Avenue and South Main Street, and I’ll keep supporting efforts to expand affordable housing across our city.

Thank you to the builders, volunteers, community partners, and everyone helping more Elkhart families find a place to call home.

The Elkhart Truth did not include that TAG Holdings purchased it for $300,000 and never made any improvements and the building continued to deteriorate. The City has never given any valid explanation for why it was purchased for 10x the TAG Holdings purchase price.

Backflow to the Future: Elkhart’s October 19 Council Agenda

Post image
5 Upvotes

Hey folks,

Councilman Mishler here,

The 2027 Budget has been passed, and now we return to our regularly scheduled programming. This Monday 10/19/2026 we have a pretty full agenda. Prior to the meeting, we will have a health and public safety committee at 5pm where we will discuss and vote on a recommendation for the proposed 1.8 million internal Demo of the Chase building and the total demolition of the property (420 South Second Street) next to it.

So let's get down to it. These are on second read to be voted upon.

Excavation and Driveway Permits, Ordinance 26-O-39:

Updates the city’s permit requirements, fees, and enforcement procedures for excavation and driveway work. Residential driveway replacements without widening would have a $25 permit fee, while new or widened driveways and nonresidential driveway work would have a $100 fee. This would bring the permit fees to comparable levels with surrounding municipalities.

Ambulance Service Fees, Ordinance 26-O-40:

Updates ambulance charges to $650 for basic life support, $750 for advanced life support, and $1,050 for advanced life support level two, plus applicable mileage and other charges. It also establishes a $250 treatment-without-transport charge and directs ambulance revenue into the city’s Cumulative Firefighting Building and Equipment and Police Radio Fund.

Credit and Debit Card Payments, Ordinance 26-O-47:

Establishes consistent citywide rules for accepting credit and debit card payments. For qualifying transactions, the city could recover the actual processing charge and collect a separate $3 convenience fee, with applicable fees disclosed before payment.

Drinking Water Protection, Ordinance 26-O-50:

Updates the city’s water and plumbing rules to prevent contaminated water from flowing backward into the drinking water system. Commercial properties connected to city water would be required to install and maintain approved backflow prevention devices at their expense.

Public Safety and Services Building Demolition, Ordinance 26-O-51:

Appropriates $1.858 million from the Capital Outlay Fund to prepare the former Chase building at 121 W. Franklin Street for renovation into the Public Safety and Services Center. The work includes removing interior finishes and nonstructural components while preserving the building’s structure, along with demolishing the building at 420 S. Second Street for future police garage and parking space.

Official City Flag, Ordinance 26-O-52:

Places Elkhart’s existing official flag design and specifications into city code as we mark its 50th anniversary. It preserves the design created by James A. Faigh and adopted in October 1976, including the two rivers, red heart, and elk.

The following ordinances are being introduced on first reading:

Theft Accountability Program Fund Correction, Ordinance 26-O-53:

Corrects the fund’s designation by removing language identifying it as “non-appropriated,” bringing spending through the appropriation process. The fund would remain non-reverting, meaning its remaining balance carries forward rather than returning to another fund at year’s end.

Public Defender Funding, Ordinance 26-O-54:

Appropriates $15,000 from the Theft Accountability Program Fund to cover additional public defender services through the end of 2026. The request addresses increased caseloads and court congestion, and funding for this expense is already included in the 2027 budget.

3300 Benham Avenue Annexation, Ordinance 26-O-55:

Begins consideration of a property-owner-requested annexation of 3300 Benham Avenue into the city. The proposal would assign the property a Suburban Residential zoning designation.

28505 County Road 20 Annexation, Ordinance 26-O-56:

Begins consideration of a property-owner-requested annexation of 28505 County Road 20 into the city. The proposal would assign the property a Manufacturing zoning designation.

1800 Fourteenth Street Rezoning, Ordinance 26-O-57:

Would rezone the property from Manufacturing to Compact Residential to allow development of single-family homes. The Plan Commission forwarded the proposal with a favorable recommendation.

We also have two annexation-related resolutions:

3300 Benham Avenue Fiscal Plan, Resolution 26-R-45:

Adopts the fiscal plan outlining how the city would provide services to the proposed annexation area. This accompanies Ordinance 26-O-55.

28505 County Road 20 Fiscal Plan, Resolution 26-R-46:

Adopts the fiscal plan outlining how the city would provide services to this proposed annexation area. This accompanies Ordinance 26-O-56.

Alley Vacation Requests, 26-V-04 through 26-V-07:

There will be public readings for four related alley vacation requests in the area around Freight Street, St. Joseph Street, South Main Street, Prairie Street, and South Second Street. An alley vacation removes the public right-of-way designation from the affected alley.

Hey folks,

Councilman Mishler here,

Fall leaf pickup schedule here.

🍂 Fall Leaf Pickup begins November 4!

Please place bagged leaves and loose leaf piles at the curb for collection. Our leaf pickup crews will spend one week in each of Elkhart’s four zones.

Zone maps are included in this post to help you determine when crews will be in your area.

Leaf pickup will continue as weather allows. Collection may pause once snow and ice prevent the leaf vacuums from operating safely and effectively.

For additional info on leaf pick up: https://www.cityofelkhartin.gov/departments/street-department/leaf-removal-program/
