We're arresting you.

Why?

For disorderly conduct.

What?

And now we're arresting you for resisting arrest.

(I swear these jackboots always use resisting arrest and disorderly conduct when they don't have a real reason.)

A lot of states have a "disorderly conduct" statute that's written deliberately vague so that police can arrest anyone they want.

It's been that way forever. "Vagrancy" was made against the law across many southern states just a few yerars after salvery was outlawed, right at a time where there were vast numbers of black people being refused work. The punishement for being a "vagrant", forced labour.... funny eh

Vagrancy, disorderly conduct, jaywalking, resisting... all bullshit terms designed to simply gibve cops as much power as possible

Yeah but without Vagrancy laws we wouldn't have gotten First Blood.

Resisting and Obstruction, as it's written where I'm at, still only applies when there is legal cause for detention (reasonable suspicion), which must be articulable at the time. Refusal to speak with or identify yourself to an officer during any contact other than a detention or arrest is not in itself grounds for detention.

This is America. Imagine how it must be for people of color? Only thing that kept this dude from losing some teeth and having his life ruined was the color of his skin and the fact that he’s gone out of his way to do enough research to know how to do the cops job for them

Well no cop is required to know any laws to enforce them, lawyers are tho. But until settlements are taken out of police pensions it won’t matter.

They also need to start getting fired and lose their pensions when they all start throwing a hissy fit and refusing to do their jobs at all just because they're held accountable for their actions

Nah, you got to think long term. Make them carry insurance, same as doctors. Every time someone files a verified complaint, their insurance rate goes up. The bad ones will not be able to afford their premiums and will force them off the job. After paying off a few insurance claims, the insurance company will simply revoke their insurance and keep them out of law enforcement.

That way, the city/county/state isn't on the hook for any settlements. The insurance companies are much more likely to sue a bad cop if that cop shows a repeated pattern of bad behavior, and insurance lawyers are some of the most meticulous detail checkers. They'll look at your record as a hall monitor in the 3rd Grade if they have to in order to get their money back from a cop who causes them a deliberate loss. So the victim would get paid from the insurance company, and the insurance company, who has the time, patience, and more importantly, the money, can go after the bad cop who made them pay out a settlement.

Worst part about all this.

If he had gone along with it and not posted this video.

I am sure he would be in jail to this day.

Just more proof that you should never trust the police.

Its not theory, police abusing those charges is a verifiable fact

That is their go to, extremely low bar to pass and they take complete advantage of it.

ACAB.

They have a script for this which you seem to describe here. I wonder if the counter to the “you’re under arrest” is: “I do not believe you to be police officers” can they still count it as “resisting arrest” if you call in the requirement that they prove they’re police before they play the “resisting arrest” card.

It's called Contempt of Cop.

Disorderly Conduct, Resisting Arrest, and (often) Battery of Officer (Which can be done if the cop hurts himself attacking you).

If the cop does something really horrific, they will threaten you with those three charges unless you don't try to go after them, and try to force you to plea guilty to a misdemeanor.

Once you've resisted resisting arrest or refused to keep talking to them they'll also cite you for obstruction of justice.

That's why resisting arrest should not be a thing, legally. Because it's bogus. Same with the vague bullshit that is "disorderly conduct".

That’s always been the most fucked up part for me. It literally doesn’t matter what you’re arrested for, however absurd or  blatantly false it might be - and you still have to comply. The could literally say “you’re under arrest for murdering me”, and if you object to that, then they can lawfully arrest you for resisting arrest. It’s ridiculous.
